Bio
Stacy W. Thomsen is a member of DarrowEverett’s Business Litigation & Alternative Dispute Resolution and Labor & Employment Practice Groups. She advises and represents clients in complex commercial disputes, statutory privacy actions, and employment-related litigation across a range of industries.
Stacy has developed a significant focus on privacy litigation involving the California Invasion of Privacy Act (CIPA) and the federal Electronic Communications Privacy Act of 1986 (ECPA), handling more than 60 such matters in 2025 alone. She regularly counsels businesses on strategies to mitigate CIPA and ECPA exposure related to website tracking technologies such as session replay, chat widgets, tracking pixels, and analytics integrations.
In addition to her privacy work, Stacy maintains a robust labor and employment practice. She represents employees and defends employers in matters involving wage and hour compliance (including FLSA and state law claims), discrimination and harassment allegations, and employment contract disputes. She also guides employers through Department of Labor audits, internal investigations, and the implementation of compliant employment policies and procedures.
Stacy brings a preventive, compliance-driven approach to litigation and dispute resolution. Her combined experience in technology-related privacy claims and traditional labor law gives her a unique perspective on issues arising from digital monitoring, workplace surveillance, and evolving employment laws in the modern workplace. She is also a regular contributor to legal publications and thought leadership on privacy and employment law developments.
Prior Experience
Before joining DarrowEverett, Stacy worked at a boutique employment law firm in Boston. Stacy’s additional professional experience includes representing plaintiffs in class and collective action wage and hour lawsuits; representing business and property owners in eminent domain, inverse condemnation, land use, and zoning matters; and defending a top 10 Fortune 500 company in tort and malpractice matters.

Representative Matters
- Secured a favorable ruling in a proposed class action in the U.S. District Court for the Western District of Washington concerning the use of website tracking pixels. Plaintiffs alleged sensitive health information—including addiction treatment inquiries and online assessment results—was improperly transmitted to third parties such as Google and Facebook. The Court granted our motion to dismiss six of nine claims, including negligence, invasion of privacy, breach of implied contract, and consumer protection claims under Washington, Ohio, and Indiana statutes. This decision eliminates the broadest theories of liability while leaving only a limited subset of claims to proceed, providing important guidance for similar matters across jurisdictions.
- Secured a six-figure judgement on behalf of several former restaurant employees in Rhode Island for violations of the Fair Labor Standards Act and Rhode Island Minimum Wage Pay Act. The restaurant failed to pay our clients proper overtime and wages in a timely manner, resulting in an award of liquidated damages and attorney’s fees and costs to our clients.
- Scored a significant win on behalf of a Massachusetts cannabis retailer, securing a $3.4 million damages judgment for the client stemming from a theft of proprietary information.
- Successfully defended a multistate cannabis company in a high-stakes $2.5 million commercial lease dispute following a 7-day jury trial in Massachusetts Superior Court. The plaintiff, a commercial landlord, alleged breach of a letter of intent, breach of contract, and multiple violations of Massachusetts unfair and deceptive trade practices laws. The jury ultimately found in favor of our client, resulting in a complete defense verdict.
- Secured important victories in both Rhode Island state and federal courts—decisions which require the Town of Johnston to discharge an illegal recording against our clients’ property purporting to “take” by eminent domain. The ruling effectively returns the property back to our clients, who intend to build affordable housing units.
Negotiated favorable high seven-figure settlement for commercial real estate client whose income property was condemned for a freeway expansion project. - Successfully represented client owner of rehabilitation facilities against neighbors regarding zoning and nuisance issues.
Represented property owner initially subject to full condemnation of commercial real estate and business operating on the property, negotiating a partial take and a 10-year temporary construction easement. - Active member of trial team obtaining seven-figure trial verdict in favor of property/business owner clients in eminent domain matter.
- Active member of appellate team obtaining favorable California Supreme Court ruling, overturning prior case law, regarding limitations of early motions in limine with respect to dispositive liability issues in inverse condemnation involving disputes over property value and business valuation.
